Using this website

This website provides information about NuLeaf Design, our creative services and how to enquire about a potential project. You agree to use the website lawfully and responsibly.

Project enquiries and agreements

Preparing or submitting a project enquiry does not create a client relationship, guarantee our availability, confirm a price or oblige NuLeaf Design to accept the project. Enquiries are an opportunity to understand your requirements and discuss whether we are a suitable fit.

Before work begins, the relevant project details will be confirmed separately in writing. Depending on the project, this may include the scope of work, deliverables, fees, payment arrangements, timelines, revisions, responsibilities, intellectual property rights and any ongoing support.

Where a separate proposal, quote or service agreement applies, its agreed terms will govern the relevant project. If there is a conflict between these website terms and a signed project agreement, the project agreement will take precedence for that project to the extent of the conflict.

Services, pricing and estimates

Information about our services, packages, prices and processes is provided for general guidance. Unless expressly stated otherwise, website prices and estimates are indicative and may change depending on project requirements, complexity, third-party costs and agreed deliverables.

A quote or proposal will set out the applicable pricing and conditions. Additional work, changes to the agreed scope or requests outside the original agreement may involve additional fees and revised timeframes. Any such changes will be discussed and agreed as appropriate before the additional work proceeds.

Payments and cancellations

Payment terms, deposits, instalments, invoicing arrangements and cancellation conditions will be set out in the relevant quote, proposal or project agreement.

If you engage NuLeaf Design for a project, you agree to meet the payment obligations and other responsibilities set out in that agreement. Any applicable rights under New Zealand law remain unaffected by these terms.

Your responsibilities

You are responsible for ensuring that the information, content, images, logos and other materials you provide for a project are accurate and that you have the necessary rights and permissions to use them.

You agree to provide the information, feedback, approvals and materials reasonably required to progress your project. Delays in receiving these items may affect delivery dates and project schedules.

Creative work and intellectual property

Unless otherwise agreed in writing, NuLeaf Design retains ownership of its pre-existing materials, methods, tools, concepts, reusable components and other intellectual property used in delivering its services.

Ownership, licensing and permitted use of work created specifically for a client will be governed by the relevant project agreement. Where applicable, any transfer of ownership or licence may be subject to full payment and other agreed conditions.

You must not copy, reproduce, distribute or commercially exploit material from this website without permission, except where permitted by law.

Third-party services and resources

Our website and projects may use or link to third-party services, software, fonts, hosting providers, integrations or other resources. These services may have their own terms, privacy policies, fees and usage restrictions.

Unless expressly agreed as part of a project, NuLeaf Design is not responsible for the independent operation, availability or policies of third-party services. Any third-party subscriptions, licences or ongoing costs applicable to a project should be confirmed in the relevant agreement.

Website availability and accuracy

We aim to keep our website available and its content accurate and up to date. However, we do not guarantee uninterrupted access or that every page, feature or item of information will always be available, complete or error-free.

We may update, change, suspend or remove website content and features when reasonably necessary. Information on the website should not be treated as a substitute for a specific written quote, proposal or project agreement.

Liability

To the extent permitted by New Zealand law, NuLeaf Design excludes liability for loss arising from reliance on general website information, temporary website interruptions or third-party services outside our reasonable control.

Nothing in these terms excludes, restricts or modifies any right, guarantee, remedy or liability that cannot lawfully be excluded or restricted under applicable law. Any liability relating to commissioned work will also be subject to the relevant project agreement and applicable law.
